ThDr. Peter Tirp\u00e1k, PhD.&nbsp;<\/p>\n\n\n\n<p><strong>T\u00c9MA I:<\/strong> KANONICK\u00c9 PR\u00c1VO (CCEO) VO VZ\u0164AHU KU KATECH\u00c9ZE<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-background has-black-background-color has-black-color is-style-wide\"\/>\n\n\n\n<p><strong>\u00daVOD&nbsp;<\/strong><\/p>\n\n\n\n<p>K\u00e1nonick\u00e9 pr\u00e1vo patrilo spolu s r\u00edmskym pr\u00e1vom odjak\u017eiva k tradi\u010dn\u00fdm a neopomenute\u013en\u00fdm predmetom \u0161t\u00fadia pr\u00e1vnick\u00fdch, ale tie\u017e teologick\u00fdch fak\u00falt. Tento z\u00e1ver bol reflektovan\u00fd od \u010dias zakladania stredovek\u00fdch univerz\u00edt, na ktor\u00fdch bola za\u010dat\u00e1 taktie\u017e v\u00fdu\u010dba pr\u00e1vnick\u00fdch predmetov. V s\u00fa\u010dasnosti tak\u00e1to v\u00fdu\u010dba v prostred\u00ed s teologick\u00fdm zameran\u00edm znamen\u00e1 h\u013eadanie s\u00favislost\u00ed jasne deklarovan\u00fdch predpisov so \u017eivotom v spolo\u010denstve Cirkvi. Mo\u017eno tu zahrn\u00fa\u0165 i usmernenia a predpisy t\u00fdkaj\u00face sa katech\u00e9zy, ktor\u00e1 patr\u00ed medzi \u00fastredn\u00e9 \u010dinnosti Cirkvi.&nbsp;<\/p>\n\n\n\n<p><strong>\u00daloha k\u00e1nonick\u00e9ho pr\u00e1va pri rozvoji katechiz\u00e1cie&nbsp;<\/strong><\/p>\n\n\n\n<p>K\u00e1nonick\u00e9 pr\u00e1vo bolo p\u00f4vodne s\u00fa\u010das\u0165ou teol\u00f3gie. A\u017e mn\u00edch Gratianus vy\u010dlenil k\u00e1nonick\u00e9 pr\u00e1vo ako samostatn\u00fa, vedeck\u00fa pr\u00e1vnick\u00fa discipl\u00ednu. Jeho zbierka <em>Discordantium canonum concordia <\/em>z roku 1140 tvorila a\u017e do za\u010diatku 20. storo\u010dia z\u00e1klad prame\u0148ov k\u00e1nonick\u00e9ho pr\u00e1va latinskej cirkvi. Bola \u010das\u0165ou zbierky k\u00e1nonov uverejnenej v roku 1580 r\u00edmskym p\u00e1pe\u017eom Gregorom XIII. pod n\u00e1zvom <em>Corpus Iuris Canonici<\/em>, ktor\u00e1 platila spolu s \u010fal\u0161\u00edmi p\u00e1pe\u017esk\u00fdmi predpismi a\u017e do roku 1918.&nbsp;<\/p>\n\n\n\n<p>V roku 1917 vyhl\u00e1sil p\u00e1pe\u017e Benedikt XIV. prv\u00fd jednotn\u00fd kodifikovan\u00fd pr\u00e1vny text s n\u00e1zvom <em>Codex iuris canonici <\/em>(\u010falej CIC), ktor\u00fd platil \u010fal\u0161\u00edch 65 rokov. Od 27. novembra 1983 je \u00fa\u010dinn\u00fd <em>Codex iuris canonici<\/em>, vyhl\u00e1sen\u00fd p\u00e1pe\u017eom J\u00e1nom Pavlom II. S\u00fa\u010das\u0165ou cirkevn\u00e9ho pr\u00e1vneho poriadku je tie\u017e zbierka k\u00e1nonov s n\u00e1zvom <em>Codex canonum ecclesiarum orientalium <\/em>(\u010falej CCEO). K\u00f3dex je ur\u010den\u00fd pre v\u00fdchodn\u00e9 katol\u00edcke cirkvi, ofici\u00e1lne vyhl\u00e1sen\u00fd p\u00e1pe\u017eom J\u00e1nom Pavlom II. v roku 1990, pri\u010dom \u00fa\u010dinnos\u0165 nadobudol d\u0148a 1. okt\u00f3bra 1991.&nbsp;<\/p>\n\n\n\n<p>V kompara\u010dnom poh\u013eade vz\u00e1jomn\u00e9ho vz\u0165ahu oboch pr\u00e1vnych noriem je treba vn\u00edma\u0165 znenie prv\u00fdch k\u00e1nonov: <em>CIC K\u00e1n. 1 \u2013 \u201eK\u00e1nony tohto K\u00f3dexu sa vz\u0165ahuj\u00fa iba na latinsk\u00fa cirkev.\u201c CCEO K\u00e1n. 1 \u2013 \u201eK\u00e1nony tohto K\u00f3dexu sa vz\u0165ahuj\u00fa na v\u0161etky a len v\u00fdchodn\u00e9 katol\u00edcke cirkvi, ak nie je vo vz\u0165ahu k latinskej cirkvi v\u00fdslovne ustanoven\u00e9 nie\u010do in\u00e9.\u201c&nbsp;<\/em><\/p>\n\n\n\n<p>Ak porovn\u00e1me tieto dve normy, zist\u00edme, \u017ee v\u00fdchodn\u00fd katol\u00edk nie je viazan\u00fd z\u00e1padn\u00fdm k\u00f3dexom a naopak. To ale neznamen\u00e1, \u017ee by CIC nebral do \u00favahy v\u00fdchodn\u00fdch katol\u00edkov. Implicitne tak m\u00f4\u017eeme ch\u00e1pa\u0165 CIC k\u00e1non 1 ako k\u00e1non 1&nbsp;v CCEO, t. j., \u017ee nezav\u00e4zuje iba latinsk\u00fa cirkev, pokia\u013e, \u010do sa t\u00fdka vz\u0165ahov s v\u00fdchodn\u00fdmi cirkvami, nie je povedan\u00e9 inak. Naopak, v\u00fdchodn\u00fd k\u00f3dex, aj ke\u010f sa z\u00e1sadne t\u00fdka iba v\u00fdchodn\u00fdch katol\u00edckych cirkv\u00ed, vz\u0165ahuje sa aj na latinsk\u00fa cirkev, ak je to v\u00fdslovne stanoven\u00e9. V\u00fdslovne znamen\u00e1 tak explicitne, ako aj implicitne. Tieto v\u00fdchodn\u00e9 normy s\u00fa tak s\u00fa\u010das\u0165ou z\u00e1padnej k\u00e1nonickej legislat\u00edvy. V oboch pr\u00edpadoch (CCEO a CIC) sa vn\u00edma katechetick\u00e1 \u010dinnos\u0165 ako slu\u017eba Slova. Touto slu\u017ebou Cirkev vykon\u00e1va funkciu vyu\u010dovania, ktor\u00e1 jej bola zveren\u00e1 Kristom spolu so slu\u017ebou posv\u00e4covania. K\u00f3dex k\u00e1nonov v\u00fdchodn\u00fdch cirkv\u00ed m\u00e1 v plnej miere uplatnenie v samotnej katechiz\u00e1cii.&nbsp;<\/p>\n\n\n\n<p>K\u00e1nony pripom\u00ednaj\u00fa a d\u00e1vaj\u00fa jasne na vedomie, \u017ee katechizovanie kres\u0165ansk\u00e9ho \u013eudu je hlavnou a v\u00e1\u017enou \u00falohou pastierov du\u0161\u00ed. Katech\u00e9za sa predstavuje ako prav\u00e1 v\u00fdchova k viere, ktor\u00e1 sa m\u00e1 dia\u0165 nielen doktrin\u00e1lnou form\u00e1ciou, ale aj sk\u00fasenos\u0165ou s kres\u0165ansk\u00fdm \u017eivotom. Katech\u00e9za sa pod\u013ea cirkevn\u00e9ho pr\u00e1va st\u00e1va zodpovednos\u0165ou v\u0161etk\u00fdch kres\u0165anov, no najm\u00e4 rodi\u010dov.&nbsp;<\/p>\n\n\n\n<p><strong>NA\u0160A \u00daLOHA:&nbsp;<\/strong><\/p>\n\n\n\n<p>Na z\u00e1klade k\u00e1n. 621 \u00a7 1 a 2 v CCEO sa sna\u017ei\u0165 o tvorbu katechetick\u00e9ho direkt\u00f3ria, ktor\u00e9 m\u00e1 by\u0165 vypracovan\u00e9&nbsp;v metropolitn\u00fdch (ale aj v patriarch\u00e1lnych) cirkv\u00e1ch. Vy\u017eaduje sa, aby sa pam\u00e4talo na osobitn\u00fa povahu v\u00fdchodn\u00fdch&nbsp;cirkv\u00ed nato\u013eko, aby v katechetickom vyu\u010dovan\u00ed \u017eiarila d\u00f4le\u017eitos\u0165 Biblie a bohoslu\u017eby, ako aj trad\u00edcie vlastnej cirkvi sui iuris&nbsp;v patrol\u00f3gii, hagiografii a ikonografii.&nbsp;<\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-background has-black-background-color has-black-color is-style-wide\"\/>\n\n\n\n<p><strong>LITERAT\u00daRA:&nbsp;<\/strong><\/p>\n\n\n\n<p>AMARNAD, A.: Catholic Eastern Churches and Their Faith Formation.
